- “Drivers” means independent taxi operators (including airport taxi drivers) who provide transportation services to Customers.
- “Customer” / “User” means any individual or entity using the Taxitics Fiji platform for bookings or payments.
- “Website” refers to www.taxiticsfiji.com and all subpages operated under this domain.
- “Daimhub” refers to Daimhub, the independent third-party developer and maintainer of the website.
2. Services Provided
- Taxitics Fiji provides an online platform for Customers to book rides with local and airport taxi drivers.
- Taxitics Fiji acts solely as an intermediary platform and does not own vehicles or employ drivers.
- All travel services are delivered by independent third-party drivers.
3. Payments
- Customers may pay for services via EFTPOS or approved online payment gateways.
- All transactions are processed securely through third-party providers.
- Taxitics Fiji does not store or retain customer payment card details.
- Daimhub has no involvement in processing payments and bears no responsibility for payment failures, disputes, or fraudulent transactions.
4. Customer Obligations
Customers agree to:
- Provide accurate and complete booking information (including pickup, drop-off, and contact details).
- Be present at the pickup location at the agreed time.
- Use the services lawfully and not engage in fraudulent activity.
- Treat drivers with respect and comply with Fiji’s transport laws.
5. Driver Responsibilities
- Drivers are independent contractors, not employees of Taxitics Fiji.
- Drivers are solely responsible for the quality, safety, timeliness, and completion of transport services.
- Taxitics Fiji does not control driver behavior, driving conduct, or the condition of vehicles.
6. Limitation of Liability
- Service Disclaimer: Taxitics Fiji is not liable for:
- Delays, missed connections, or cancellations caused by drivers.
- Vehicle condition, driver conduct, or quality of service.
- Lost items, accidents, or damages incurred during travel.
- Any disputes arising between Customers and drivers.
- Payment Disclaimer:
- Taxitics Fiji is not responsible for errors, delays, or failures in third-party payment systems.
- Refunds and cancellations are governed strictly by the Refund & Cancellation Policy.
- Daim Hub Disclaimer:
- Daimhub is responsible only for the creation, hosting, and maintenance of this website.
- Daimhub does not operate Taxitics Fiji, manage bookings, process payments, or oversee communications.
- Daimhub accepts no liability whatsoever for miscommunication, misleading content, fraud, service failure, disputes, or damages arising from use of this website.
- By using this website, the Customer acknowledges and agrees that Daimhub is held harmless from all claims, liabilities, losses, or damages connected with Taxitics Fiji’s operations.
7. Intellectual Property
- All website content, branding, logos, and materials belong to Taxitics Fiji unless otherwise stated.
- Daimhub retains intellectual property rights over its web development and technical work.
8. Data Protection
- Personal data is collected and processed according to the Privacy Policy.
- Taxitics Fiji is solely responsible for data collection, compliance, and safeguarding customer information.
- Daimhub has no access to or responsibility for customer data.
9. Indemnity
The Customer agrees to indemnify and hold harmless Taxitics Fiji, its owners, employees, drivers, agents, affiliates, and Daimhub from any claims, losses, damages, liabilities, costs, or expenses arising from:
- Misuse of the website or services.
- Disputes with drivers.
- Payment issues, fraud, or chargebacks.
- Breach of these Terms.
10. Governing Law & Jurisdiction
These Terms are governed by the laws of Fiji. Any disputes shall be resolved under the exclusive jurisdiction of the courts of Fiji.
